🇬🇧 Terms & Conditions (Compliant with the Implementing Regulations of the Saudi E-Commerce Law)

Welcome to Top Spa. By using our website or booking any service, you agree to the following Terms & Conditions, which fully comply with the Saudi Electronic Commerce Law and its Implementing Regulations.


1. Service Provider Information (Article 6)

3. Booking & Contract Formation (Article 7)

  • By clicking “Confirm Booking” or completing payment, a binding contract is formed between the customer and Top Spa.

  • The checkout page clearly states:
    “Confirming your booking means you agree to the obligation to pay.”

  • Customers must enter accurate and correct information.

  • The booking is confirmed only after receiving a confirmation message via SMS, WhatsApp, or email.


4. Pricing & Payment (Articles 7 & 8)

Prices include:

  • Service price

  • Applicable taxes

  • Home-visit fees (if applicable and clearly stated beforehand)

Available payment methods:
Cash – Mada – Visa/Mastercard – Apple Pay – Online payment gateways – Tabby – Tamara – Bank transfer.

An electronic receipt will be issued containing:

  • Service provider name

  • Description of the service

  • Total amount

  • Tax value (if applicable)

  • Transaction date

  • Payment confirmation


5. Cancellation & Rescheduling Policy

  • Booking may be canceled or modified at least 2 hours before the appointment time.

  • Late cancellation may result in charging the full service amount.

  • No-show clients may be restricted from booking during peak hours.

  • Customers should arrive 15 minutes before the appointment to confirm the booking.


6. Refund Policy (Article 11)

Refunds are granted only in the following case:

  • If Top Spa cancels the appointment and no alternative time is available.

Refund processing time: 5–14 business days.

The customer is not entitled to a refund in the following cases (according to Article 11):

  • After the service has started

  • When the home-service therapist arrives and the customer refuses service

  • For services designed or customized upon the customer’s request

  • For seasonal promotions once they have started


7. Home Services (Women’s Section)

  • Fees may vary depending on location.

  • The customer must provide a safe and suitable environment for the service.

  • If the staff arrives and the customer refuses the service, 50% of the service value will be charged.


8. Personal Data Protection (Article 5)

Top Spa is committed to:

  • Protecting customer data and preventing unauthorized access

  • Not using customer data for marketing unless consent is provided

  • Deleting customer data when no longer needed

Customers have the right to:

  • Access their personal data

  • Modify their data

  • Request deletion of their data


9. Electronic Advertising (Article 10)

  • All advertisements must clearly state that they are advertisements.

  • Advertisements must contain accurate information.

  • Customers may opt out of promotional messages at any time.


10. Customer Responsibilities

  • Providing accurate information

  • Arriving on time

  • Ensuring a suitable environment for home services

  • Treating staff respectfully

Any inappropriate behavior will result in cancellation of the service without a refund.


11. Limitation of Liability

Top Spa is not responsible for:

  • Personal belongings left inside the branch

  • Allergies or health issues not disclosed by the customer

  • Customer dissatisfaction after the service has been completed

Our liability is limited to the value of the purchased service only.


12. Governing Law

These Terms & Conditions are governed by the Saudi Electronic Commerce Law and its Implementing Regulations published in the Official Gazette, based on the uploaded document (pages 1–14).
